McMullen sentenced to probation

MILLEDGEVILLE — Tammi Lynn McMullen, convicted in 2011 in the deaths of Alvin Harris and Buford Prosser, pleaded guilty and was sentenced to 10 years probation Friday.

McMullen receives credit for time served dropping her probation period to eight and a half years. She has already served 17 months in prison.

“We were content with the amount of time that she's already served in prison, so we pled her to time served plus more probation,” Ocmulgee Judicial Circuit District Attorney Fred Bright said. 

Both victims' families were present and OK with the Friday outcome.

“I told the court that this plea had their blessing. They were content and felt it was fair,” Bright said.

Fifty-five-year-old Harris and 64-year-old Prosser, both of Gordon, were killed after attempting to re-attach a trailer loaded with pine straw to a pickup truck. The truck was stopped in the fast lane of U.S. 441 North near Cowboys when McMullen ran into the rear of the trailer. 

Harris died at the scene. Prosser died hours later at a Macon trauma center due to blood loss.

McMullen was convicted on two counts of vehicular homicide and one count of DUI following a weeklong trial in February 2011. During the trial, blood tests revealed the presence of methamphetamine and other prescription drugs in her blood. 

McMullen entered prison following the trial, serving a little more than 17 months until the Georgia Court of Appeals overturned the conviction last summer.

During the trial, Bright introduced evidence that McMullen had pleaded guilty to another crime involving methamphetamine in the 1990s. The Court of Appeals ruled that the case did not warrant the inclusion of the evidence since the prior incident was for possession with intent to distribute and not use.
