Man, 22, gets probation in December assault

MILLEDGEVILLE — Garrett Thomas Smith, 22, pleaded guilty to battery, criminal trespass and harassing phone calls misdemeanors stemming from a Dec. 15, 2012 assault of a 20-year-old. He was sentenced to 36 months probation.

Ocmulgee Judicial Circuit District Attorney Fred Bright said the plea had the victim’s family and law enforcement approval.

“Everybody involved in this case thought the plea was fair,” Bright said. “It was a very unfortunate circumstance, and hopefully nothing like this will ever happen again.”

Smith must pay a $2,000 fine plus additional statutory fee and just more than $3,000 for the total medical bill, as well as remain under probationary misdemeanor supervision. 

Stay away orders for the immediate family of the victim and eight other witnesses were part of the plea also.

The incident occurred at 4:35 a.m. Dec. 15 at the victim’s Cobblestone Park Drive residence. 

According to the Milledgeville Police report, Smith and two others entered the residence through an unlocked door. The victim told the responding officer he was in his upstairs bathroom when grabbed and assaulted by an unknown male.

The victim said he blacked out and woke up in the bathtub with his girlfriend. 

Bright said the victim had a black eye and a mild concussion. Smith admitted he was the one who did the beating.
